Reporting workplace misconduct

Whistleblower protection is in place at the Company in accordance with Act No. 171/2023 Coll. on the protection of whistleblowers (also referred to as the "Whistleblower Protection Act") and Directive (EU) 2019/1973 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report infringements of Union law (the "Directive"). Pursuant to the Company's obligations under the aforementioned regulations, an internal whistleblowing system ("ISS") has been established through which whistleblowers have the opportunity to raise concerns about a potential violation that has the characteristics of a criminal offence, misdemeanour or otherwise violates a law or regulation of the European Union, which the whistleblower has become aware of in connection with work or other similar activity.

The main objective of whistleblower protection is to enable the detection of possible illegal conduct at the Company's workplaces or illegal conduct occurring in the course of the work (or other similar) activities of the Company's employees. These are illegal acts which employees and persons in a similar position (hereinafter referred to as employees) do not normally report to the Company or the relevant government authorities, in particular for fear of losing their jobs or being otherwise penalised. However, it may also be a report of another violation that is not related to the Company's activities, but which the whistleblower has learned about in connection with his or her work. It is important to note that it is the employee's right, not the employee's obligation, to report a suspected violation.

A whistleblower can only be a natural person who should act in the public interest and in the good faith belief that the notification is based on credible facts and facts. A whistleblower is entitled to protection under the above-mentioned regulations (in particular, the provisions of Section 7 of the ZOO) if he or she had reasonable grounds to believe that the information reported about the infringement was true at the time of notification (i.e. The whistleblower must not have made the notification knowingly false), that the information fell within the scope of the notifiable information and at the same time if the whistleblower made the notification through a VOS, an external notification system, by publication or through another competent public authority. The main protective measure may be considered to be a prohibition of retaliation against the whistleblower and other natural and legal persons (e.g. colleagues, assistants of the whistleblower, persons close to the whistleblower, legal persons of which the whistleblower is a partner, etc.).

In the course of notification, contractual confidentiality and confidentiality under other regulations (e.g. tax regulations, banking secrecy, medical secrecy, etc.) may be breached only if the notifier has reasonable grounds to suspect that by making the notification he/she is taking steps to eliminate the infringement.

The options for submitting a notification through the Company's VOS are:

  • via the web form
  • in writing to Průmyslová 1420, 59301 Bystřice nad Pernštejnem, please indicate on the envelope the text: 'NOTICE - Only to the hands of the competent person'.
  • by telephone: 565 400 332 (the notification can be written down in a record with the possibility of checking the record afterwards, correcting it and confirming the corrections with the signature of the notifier)
  • by email (only the person authorised to receive and investigate the notification has access to this email): oznamovatel@cormen.cz
  • in person: by appointment only, by telephone or e-mail, it is possible to arrange a personal meeting
